Someone passed away in Germany. Here is what happens next.
A letter from a German court, a bank account nobody can access, a house in a town you have never visited. We take care of the German side for American heirs — in English, and usually without a trip to Germany.
What happens after a death in Germany
German probate works differently from probate in the US. There is no executor appointed by default — the heirs take over the estate automatically, including any debts.
Check the deadline
If you do not want the inheritance, you must disclaim it in time: six weeks, or six months if the deceased’s last residence was outside Germany or you were abroad when the period started (§ 1944 BGB). Until then, do not touch any estate assets.
Gather the documents
Death certificate, a copy of the will if there is one, and proof of your relationship to the deceased, such as birth and marriage certificates.
Certificate of inheritance
German banks and the land registry usually ask for a certificate of inheritance (Erbschein). You give the required sworn statement at a German consulate in the US or before a notary — we prepare everything.
Accounts, property and taxes
We release the bank accounts, arrange the sale or transfer of real estate, file the German inheritance tax return if required, and make sure your share reaches you in the US.

Frequently asked questions
Do I have to travel to Germany?
In most cases, no. Signatures and sworn statements can usually be given at a German consulate in the US or before a US notary with an apostille.
Will I have to pay German inheritance tax?
That depends on where the deceased and you lived, on the value you receive and on your relationship to the deceased. Close relatives have generous tax-free allowances. We check this for you at the start.
Can I refuse an inheritance with debts?
Yes, by disclaiming it within the deadline. Please do not withdraw or use anything from the estate before you decide.
